Terms and Conditions of Service

Last updated: August 2025

PLEASE READ THESE TERMS CAREFULLY. BY OPENING AN ACCOUNT, USING AN MMC LOGISTICS ADDRESS, SHIPPING ANY PACKAGE TO OUR FACILITY, OR OTHERWISE USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.

These Terms and Conditions of Service (the “Terms”) apply to the package receiving, consolidation, forwarding, and related services of JC Global Consulting LLC, doing business as MMC Logistics, 7082 NW 50th St, Miami, FL 33166. Use of our website and partner portal is also governed by our Terms of Service.

1. Definitions

1.1 “MMC,” “we,” “us,” and “our” mean JC Global Consulting LLC d/b/a MMC Logistics, its employees, agents, and contractors.

1.2 “Customer,” “you,” and “your” mean any person or entity that holds an MMC account, uses an MMC address, ships or causes a Package to be shipped to MMC’s facility, or receives services from MMC, whether directly or through one of MMC’s Partners.

1.3 “Partner” means any company outside the United States that provides MMC addresses or services to its own members, customers, or clients.

1.4 “Package” means any parcel, envelope, box, pallet, or other item delivered to MMC’s facility.

1.5 “Account Code” means the unique code assigned to each Customer by MMC or by the Customer’s Partner, in the format that MMC or the Partner specifies (for example, XX-XXXXX). The Account Code identifies the Customer’s account and, where applicable, the destination or type of service.

1.6 “Unknown Package” means any Package that cannot be matched to a Customer account because the Account Code is missing, incomplete, incorrect, illegible, or does not match an active account.

2. Addressing Requirements

2.1 Every Package shipped to MMC must display the Customer’s full name and complete, correct Account Code, exactly as assigned, as part of the shipping address on the carrier label.

2.2 The Account Code is how MMC identifies the Customer and routes the Package. A Package with a missing, incomplete, or incorrect Account Code cannot be reliably identified or routed.

2.3 The Customer is solely responsible for ensuring that the Account Code and the Customer’s name are entered correctly with every merchant, seller, or shipper, and that they appear on the carrier label. Errors made by a merchant, marketplace, or third-party shipper are considered the Customer’s responsibility as between the Customer and MMC.

2.4 MMC is not required to investigate, interpret, or guess the intended recipient of any Package that is not properly addressed in accordance with this Section.

3. Unknown Packages

3.1 Any Package that does not comply with Section 2 will be treated as an Unknown Package and placed in MMC’s unknown inventory.

3.2 MMC may make Unknown Packages available for identification to its Partners and, through them, to their customers. MMC does not publish Unknown Package details to the general public. A person may claim an Unknown Package by providing, at a minimum, the inbound carrier tracking number and proof of purchase (such as an order confirmation or invoice), together with any other information MMC reasonably requests.

3.3 MMC’s release of an Unknown Package to a person who provides identifying information in accordance with Section 3.2 fully satisfies MMC’s obligations with respect to that Package. MMC SHALL HAVE NO LIABILITY to any other person, including the person who purchased or shipped the Package, for any loss, misdelivery, delay, or damage resulting from that release.

3.4 If an Unknown Package is released to another party, the Customer’s sole recourse is against the party who claimed and received it. As a courtesy, and without assuming any liability, MMC may make reasonable efforts to contact that party and request return of the Package, but MMC does not guarantee recovery.

3.5 Unknown Packages that remain unclaimed for thirty (30) days after receipt are deemed abandoned. After giving any notice required by law, MMC may return the Package to the sender, donate it, sell it to recover costs, or dispose of it. MMC has no liability for any Package handled under this Section.

3.6 MMC may charge a reasonable handling and storage fee for identifying, holding, or relabeling any Unknown Package.

4. Customer Responsibilities

4.1 The Customer is responsible for:

  • (a) providing accurate and complete account, contact, and address information, and keeping it up to date;
  • (b) using the correct Account Code on every Package (Section 2);
  • (c) promptly tracking purchases and notifying MMC of expected Packages when requested;
  • (d) providing accurate descriptions and values of Package contents for customs, security, and export purposes;
  • (e) ensuring that no Package contains prohibited or restricted items (Section 11); and
  • (f) paying all applicable fees, freight charges, duties, taxes, and other charges.

4.2 The Customer is responsible for keeping his or her Account Code and login credentials confidential. MMC is not liable for any loss resulting from the Customer sharing his or her Account Code or credentials with others.

5. Receipt and Condition of Packages

5.1 A Package is considered received by MMC only when it is physically scanned into MMC’s warehouse system. Delivery confirmations, “delivered” statuses, signatures, or photos issued by USPS, UPS, FedEx, Amazon, DHL, or any other carrier do NOT constitute proof that MMC received the Package.

5.2 MMC is not responsible for Packages lost, stolen, damaged, or misdelivered before they are scanned into MMC’s warehouse. Claims for such Packages must be filed by the Customer with the merchant or the delivering carrier.

5.3 MMC does not open, inspect, or verify the contents of Packages except as required for security screening, customs or export compliance, damage assessment, or repacking under Section 9, and is not responsible for missing, incorrect, or defective contents shipped by a merchant.

5.4 MMC may photograph Packages and labels upon receipt. These records are deemed accurate evidence of the Package’s condition and labeling at the time of receipt.

5.5 Storage. MMC stores Packages free of charge for thirty (30) days after they are scanned into MMC’s warehouse. If a Package remains at MMC for more than thirty (30) days for any reason not caused by MMC, including missing payment, instructions, or documents, MMC is no longer responsible for it: the Package is held at the Customer’s sole risk, MMC may charge storage fees at its current rates, and, after giving any notice required by law, MMC may treat the Package as abandoned under Section 3.5.

5.6 Returns to merchants. MMC does not handle returns, exchanges, or refunds with merchants or sellers. At the Customer’s request, MMC may return a Package to the merchant at the Customer’s cost, but MMC is not responsible for the merchant accepting the return or issuing a refund or credit.

6. Empty, Damaged, or Opened Packages on Arrival

6.1 MMC does not forward Packages that arrive at its facility empty, damaged, opened, leaking, or showing signs of tampering.

6.2 When MMC receives such a Package, it will record the Package’s condition, which may include photos and weight, and notify the Customer or the Customer’s Partner.

6.3 MMC will hold the Package for fifteen (15) days for instructions. Within that time the Customer may ask MMC to return the Package to the sender, at the Customer’s expense, or to dispose of it. If MMC receives no instructions within fifteen (15) days, the Package is deemed abandoned and may be handled as described in Section 3.5.

6.4 All claims for Packages that arrive at MMC empty, damaged, opened, or incomplete must be made by the Customer directly with the shipper (the merchant, seller, or other party that sent the Package) or with the delivering carrier. MMC has no liability for these Packages.

7. Damage at Destination

7.1 MMC is not responsible for Packages that arrive at the destination damaged. All claims for damage must be made by the Customer directly with the shipper (the merchant, seller, or other party that sent the Package).

7.2 The Customer should inspect each Package at pickup or delivery and report any visible damage to the Partner at that time.

8. Fragile, Perishable, and High-Value Items

8.1 MMC is not liable for breakage of fragile items (including glass, ceramics, screens, and electronics that are not in protective packaging) or for spoilage of perishable items.

8.2 The Customer must notify MMC, or the Customer’s Partner, in writing before shipment of any Package whose contents are valued at more than five hundred U.S. dollars (US $500.00). MMC may decline the Package, require special handling at an additional fee, or require additional coverage if offered. If a high-value Package is not declared, the limits in Section 10 apply.

9. Repacking and Consolidation

9.1 MMC may repack or consolidate Packages, or remove excess packaging, to protect the contents, meet airline or security requirements, or reduce billable weight.

9.2 MMC is not liable for any loss of original packaging, or for any effect on merchant returns or warranties, resulting from repacking or consolidation done in good faith.

10. Limitation of Liability

10.1 TO THE FULLEST EXTENT PERMITTED BY LAW, MMC’S TOTAL LIABILITY FOR ANY LOSS, DAMAGE, OR DELAY OF ANY PACKAGE, FROM ANY CAUSE, INCLUDING ANY LIABILITY THAT CANNOT BE EXCLUDED UNDER SECTIONS 6 THROUGH 9, IS LIMITED TO THE LESSER OF: (a) THE ACTUAL DOCUMENTED PURCHASE VALUE OF THE CONTENTS; (b) ONE HUNDRED U.S. DOLLARS (US $100.00) PER PACKAGE; OR (c) THE LIMITS ESTABLISHED BY ANY APPLICABLE INTERNATIONAL CONVENTION, INCLUDING THE MONTREAL CONVENTION, UNLESS THE CUSTOMER HAS PURCHASED ADDITIONAL COVERAGE FROM MMC, IF OFFERED, BEFORE SHIPMENT.

10.2 MMC SHALL HAVE NO LIABILITY WHATSOEVER FOR:

  • (a) any Package that does not meet the addressing requirements of Section 2;
  • (b) any Unknown Package, including any Unknown Package released under Section 3;
  • (c) any Package not yet scanned into MMC’s warehouse (Section 5);
  • (d) any Package that arrived at MMC empty, damaged, opened, or incomplete (Section 6);
  • (e) any damage discovered at the destination (Section 7);
  • (f) breakage of fragile items, spoilage of perishable items, or undeclared high-value items (Section 8);
  • (g) seizure, inspection, delay, or destruction of any Package by customs, the TSA, or any other government authority;
  • (h) delays caused by airlines, carriers, Partners, weather, strikes, customs processing, or other events beyond MMC’s reasonable control (Section 17);
  • (i) prohibited, restricted, or improperly declared items;
  • (j) packaging that is insufficient to protect the contents;
  • (k) any Package held at MMC for more than thirty (30) days after receipt (Section 5.5); or
  • (l) any Package after MMC’s responsibility has ended under Section 16.4.

10.3 IN NO EVENT SHALL MMC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF BUSINESS, OR LOSS OF USE, EVEN IF MMC HAS BEEN ADVISED OF THEIR POSSIBILITY.

10.4 Additional coverage, if MMC offers it, must be requested and paid for before the Package is shipped from MMC’s facility. Coverage is subject to its own terms and does not apply to the exclusions listed in Section 10.2.

11. Prohibited and Restricted Items

11.1 The Customer shall not ship, or cause to be shipped, any item prohibited by U.S. law, the laws of the destination country, TSA or airline regulations, or MMC policy. This includes, but is not limited to, hazardous materials, explosives, firearms and ammunition, illegal drugs, currency, counterfeit goods, and any item classified as dangerous goods under IATA regulations.

11.2 MMC may refuse, hold, return, or surrender to authorities any Package it reasonably believes contains prohibited or restricted items, without liability to the Customer.

12. Security Screening and Customs

12.1 MMC operates as a TSA-approved Indirect Air Carrier. By using MMC’s services, the Customer consents to the screening, inspection, and opening of any Package by MMC, the TSA, U.S. Customs and Border Protection, destination customs authorities, or any airline, as required by law or regulation.

12.2 The Customer is responsible for all duties, taxes, and fees imposed by the destination country, and for any fines or penalties resulting from inaccurate declarations or prohibited contents.

13. Export Compliance

13.1 The Customer must comply with all U.S. export control and sanctions laws, including the Export Administration Regulations and the sanctions programs administered by the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC).

13.2 The Customer must provide accurate and complete information that MMC needs for export filings, including Electronic Export Information (EEI) where required, for example when the value of goods under a single Schedule B number exceeds US $2,500 or when an export license is required.

13.3 The Customer must not ship any item to or for a sanctioned country, entity, or person, or for any prohibited end use. MMC may hold or refuse any shipment pending a compliance review, without liability. The Customer is responsible for any fines or penalties resulting from inaccurate or incomplete information.

14. Claims

14.1 Any claim against MMC for a lost Package must be submitted in writing within fifteen (15) days after the date MMC dispatched the Package or, if the Package was never dispatched, within fifteen (15) days after the date it was scanned into MMC’s warehouse. The claim must include the Account Code, the inbound tracking number, the MMC number if available, proof of purchase, and photos where applicable.

14.2 Claims for damage are governed by Sections 6 and 7 and must be made directly with the shipper or delivering carrier.

14.3 Claims not submitted within the period in Section 14.1 are waived.

14.4 Submitting a claim does not relieve the Customer of the obligation to pay any outstanding charges.

15. Fees and Payment

15.1 The Customer agrees to pay all fees and charges according to MMC’s or the applicable Partner’s current rates.

15.2 Billing weight. Charges are calculated on a per-account basis, according to the arrangement between MMC and the Customer or Partner, using either (a) the actual weight of each Package, rounded up to the next whole pound, or (b) the volumetric (dimensional) weight of each Package, calculated with the method MMC specifies for that account. MMC’s scale readings and measurements are final.

15.3 MMC holds a lien on all Packages in its possession for any unpaid charges, and may retain such Packages or, after at least thirty (30) days’ notice and any other notice required by law, sell them to recover amounts owed.

16. Partners

16.1 Customers who receive MMC services through a Partner are bound by these Terms in addition to any terms of that Partner.

16.2 MMC is not responsible for the acts or omissions of any Partner, including local delivery, pickup, customs clearance, or customer service in the destination country.

16.3 If a Customer or Partner has a signed written agreement with MMC, that agreement controls wherever it conflicts with these Terms.

16.4 End of MMC’s responsibility. To the extent permitted by law, MMC’s custody of and responsibility for a Package end when MMC delivers the Package to the airline for transport to the Partner, or to the Partner or its agent at the destination, whichever occurs first. After that point, any delay, loss, or other problem with the Package is the responsibility of the Partner or the carrier then in possession of it.

16.5 Each Partner agrees to make these Terms available to its own members, customers, and clients, for example by displaying or linking them on its website, app, or receipts, and to inform them that MMC handles their Packages under these Terms.

17. Events Beyond Our Control

17.1 MMC is not liable for any delay or failure to perform caused by events beyond its reasonable control, including hurricanes, storms, and other severe weather; natural disasters; fire; flood; epidemics; war, terrorism, or civil unrest; strikes or labor disputes; government actions, orders, or embargoes; customs or security holds; airline or carrier cancellations, delays, or capacity limits; power, internet, or system outages; and failures of third parties.

18. Indemnification

18.1 The Customer agrees to indemnify, defend, and hold harmless MMC and its owners, employees, agents, and Partners from any claims, damages, losses, fines, penalties, and expenses (including reasonable attorneys’ fees) arising from: (a) the Customer’s breach of these Terms; (b) incorrect or incomplete addressing; (c) inaccurate declarations or export information; or (d) the shipment of prohibited or restricted items.

19. Governing Law and Disputes

19.1 These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law principles.

19.2 Any dispute arising from these Terms or MMC’s services shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and the Customer consents to the jurisdiction of those courts.

19.3 To the extent permitted by law, any claim must be brought individually and not as part of any class or representative action.

19.4 To the extent permitted by law, any lawsuit relating to these Terms or MMC’s services must be filed within one (1) year after the claim arose, or it is permanently barred.

20. Notices

20.1 MMC may give notices to the Customer by email, WhatsApp, or text message to the contact information on file, through the partner portal, through the Customer’s Partner, or by posting on mmc-logistics.com. The Customer agrees to receive communications electronically, and electronic notices satisfy any requirement that a notice be in writing.

20.2 Notices to MMC must be sent to info@mmc-logistics.com.

21. General

21.1 MMC may update these Terms at any time by posting the revised version on its website. Continued use of MMC’s services after posting constitutes acceptance of the revised Terms.

21.2 If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision shall be enforced to the maximum extent permitted.

21.3 MMC’s failure to enforce any provision is not a waiver of that provision.

21.4 These Terms, together with any signed written agreement with MMC, any Partner terms, and posted rates, are the entire agreement between the Customer and MMC regarding the services.

21.5 If these Terms are translated into another language and there is a conflict between versions, the English version governs.

21.6 Subcontractors. MMC may use airlines, trucking companies, carriers, agents, and other subcontractors to perform its services. Every limitation of liability, exclusion, and defense in these Terms, and in the terms of those subcontractors, also protects MMC to the extent permitted by law.

21.7 Sharing information. The Customer agrees that MMC may share the Customer’s name, address, contact information, and Package details with Partners, airlines, carriers, customs and security authorities, and other service providers as needed to provide the services, as described in our Privacy Policy.
